- Questioni in tema di comunione legale e partecipazioni societarie(Instituto de derecho iberoamericano, 2024) Semprini, AlessandroThe essay analyses the legal regime applicable to the company share acquired by a spouse in joint ownership of assets, in order to clarify whether it becomes immediate co- ownership pursuant to art. 177 of the Civil Code or de residuo co-ownership pursuant to art. 178 of the Civil Code. In the absence of a clear rule, the author reflects on the preferable interpretation and, from a de iure condendo point of view, proposes a reconstruction based on a fairer balance between the constitutional principles protecting the family and the freedom of economic initiative; lastly, specific in-depth studies are made on certain potentially 'modifying' and/or 'extinguishing' events of the identified legal regime.
- Los reconocimientos de complacencia en el Derecho español: estado de la cuestión(Instituto de derecho iberoamericano, 2024) Gallo Veléz, Ana SilviaLa STS 15 julio 2016 ha sentado doctrina jurisprudencial con relación a los llamados reconocimientos de complacencia mediante argumentos claros y ordenados, aunque no por ello incontrovertibles. Esta doctrina se ha visto reafirmada por la posterior STS 28 noviembre 2016. Como consecuencia de ello, las Audiencias Provinciales han resuelto los casos que han conocido conforme a este fallo. Sin embargo, la doctrina especializada se ha manifestado, desde diferentes perspectivas, con relación a tres ejes cruciales que resuelve el fallo en esta materia: el primero, la defensa de la validez del reconocimiento de complacencia; el segundo la ratificación de la legitimación del autor de este reconocimiento para entablar la acción de impugnación de la paternidad fundada en el hecho de no ser el padre del reconocido; finalmente, sobre la acción de impugnación que procede cuando el reconocedor contrae matrimonio con la madre del reconocido, recordando la diferencia que se presenta en los términos de caducidad, en consideración a la clase de filiación: matrimonial o no matrimonial.

- La medicina difensiva tra responsabilità civile, danni risarcibili e ragionevoli soluzioni interpretative(Instituto de derecho iberoamericano, 2024) Florena, MatteoThe traditional approach describes defensive medicine as a behaviour of medical practice aimed at adopting or avoiding certain diagnostic (or therapeutic) measures and decisions, inspired more by the aim of averting the risk of probable legal sequelae and sacrificing that of ensuring the patient's health and recovery. The objective of protecting the patient's health would therefore appear to become secondary to that of minimising legal risk. With this paper we wish to focus on the main socio-economic problems connected with the phenomenon of medical malpractice and the consequent spread of the phenomenon of defensive medicine, trying to offer some hermeneutic solutions to contain the excessive burden of compensation that often weighs on health professionals and hospital structures, in order to favour the much desired therapeutic alliance between doctors and patients.

Therefore, through the analysis of the most significant points of the special discipline of public management, as well as the comparison with the French model of the recently reformed ?haute foncion publique?, proposes a possible compositional solution to the many controversial aspects that emerge in the recognition of the interdependence between the administrative and political sphere of action.
- Importancia del derecho de superficie. Its Roman origins have consolidated it as an effective institution, a clear example of which is the Italian Civil Code, which presents an efficient treatment and should be reflected in the use and execution of this right. The practice in Peru, although it has been consolidating, presents the surface as a right that allows access to land in the urban, commercial and industrial sector.
- El delegado o la delegada de protección en el ámbito del ocio y el tiempo libre educativo en la Ley Orgánica de protección integral a la infancia y la adolescencia(Instituto de derecho iberoamericano, 2024) Ravetllat Ballesté, IsaacOn June 5th, 2021, Organic Law 8/2021, of June 4th, on the comprehensive protection of children and adolescents against violence, was published in the Official State Gazette. Articles 48 and 49 of the aforementioned regulation establish the basic regulatory framework for the protection of children and adolescents against violence in the field of leisure and free educational time. Both precepts contain the main obligations attributed to Public Administrations and entities that carry out activities of this nature with children on a regular basis, among which the designation of the figure of the protection delegate stands out. This study delves into the essential characteristics and the reporting principles that should guide the actions of the protection delegate, as well as articulate mechanisms that guarantee their effective and efficient implementation. Ultimately, it is intended to highlight the role of the protection delegate as an institution called not only to identify behaviors to avoid - eradicate - but also those that should be tended to ensure protective environments for children and adolescents in the field of leisure and free educational time.
- Autonomía en el ámbito sanitario de las personas con discapacidad: el dilema que plantea la ley de autonomía del paciente y su reflejo en la doctrina del TC(Instituto de derecho iberoamericano, 2024) Andreu Martínez, BelénHealth legislation and, in particular, Law 41/2002, of 14 November, for the regulation of patient autonomy (LAP) has not been adapted to the reform carried out by Law 8/2021, of 2 June. For this reason, the role that the new criteria contained in articles 249 et seq. of the Civil Code should play in the field of healthcare is discussed. This paper contains a proposal for the reform of these regulation, specifically articles 3, 5 and 9 LAP. It will also discuss how this law should be implemented until such time as it is amended. Special attention will be paid to the criteria for action by the representative provided for in article 9.6 LAP, insofar as this has been the central issue resolved by the constitutional court (TC) in its judgement 38/2023, regarding the constitutionality of judicial authorisations for the vaccination of institutionalised elderly people against COVID-19, a ruling which will also be analysed in this paper.

VIII, 31-03-2022, C-96/21(Instituto de derecho iberoamericano, 2024) Cappuccio, SusannaArticle 16(l) of Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, amending Council Directive 93/13/EEC and Directive 1999/44/EC of the European Parliament and of the Council and repealing Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and of the Council must be interpreted as meaning that the exception to the right of withdrawal provided for in that provision may be relied on against a consumer who has concluded, with an intermediary acting in its name, but on behalf of the organiser of a leisure activity, a distance contract for acquiring a right of access to that activity, provided that, first, the termination of the obligation to perform that contract vis-à-vis the consumer by means of withdrawal, in accordance with Article 12(a) of that directive, would place the risk linked to the setting aside of the capacity thus released on the organiser of the activity concerned and, second, the leisure activity to which that right gives access is scheduled to take place on a specific date or within a specific period.

- La protección de los datos personales de los niños en el espacio digital(Instituto de derecho iberoamericano, 2024) Mattace, GiulianoThis work takes a multifaceted approach to the different aspects of the phenomenon of child protection in the digital world. As is well known, the Internet represents one of the technological innovations with the greatest impact on society in recent decades. The spread of the most diverse social networks, as well as the increasingly common recourse of consumers to digital platforms for the purchase of goods and services, have transferred aspects of interpersonal relationships to the virtual dimension. This has led to an increased number of risks related to the use, sometimes misuse, of personal data. Regulation (EU) 2016/679 represents the regulatory framework that embodies the protection of the human person in the face of the evolution of new technologies: a regulatory framework aimed at combining the freedom of the individual in the so-called digital society with the invasiveness in the sphere of the individual that characterises the digital world. The concerns, for the attention of legal practitioners, relate in particular to the collection, storage and use of personal information beyond the control of the holder. That said, the author asks whether, and to what extent, the circulation of children?s data in today?s economic order is presented in different terms from that of adults and therefore requires a different regulatory response. The starting point of this research can be none other than the choice made by the European legislator to intervene to regulate the consent of minors in relation to information society services.
