- La indefinición semántica de la expresión “justicia ambiental” y sus comprensibles circunstancias estratégicas | The Semantic Lack of Definition of The Expression “Environmental Justice” and his Understandable Strategic Circumstances(2016) Ruiz Sanz, MarioABSTRACT. “Environmental justice” is a lexical binomial complex formed by a noun (justice) and a adjective (environmental), which neither means does not even suppose the priority or consistent semantic submission of a term to other one, but on the contrary: the interaction and interdependence of the linguistic components of the expression reflects a predisposition of the state of mind and even a favorable or optimistic intention towards his acceptance undetermined on the part of all, without bearing in mind the convenience of affecting in his content, pun or fuzzy in many occasions, under the necessary observation of the historical evolution of the concept from a political, social and juridical exposition.

- La doble ineficacia de la tortura | The Double Ineffectiveness of Torture(2016) García Cívico, JesúsABSTRACT. The purpose of this study is to reflect about the ineffectiveness of the right not to suffer torture and also the ineffectiveness of (illegal) recourse to torture. In the first case, the different forms of ineffectiveness are analyzed: cases of torture, impunity, lack of effective investigations. At the same time, it reviews the current mechanisms of effectiveness of this right. In the second case, the latest reports on the failure to use torture in the so-called "fight against terror" are analyzed.

- ¿Vulnerabilidad vs. Subordiscriminación? Una mirada crítica a la expansión de la vulnerabilidad en detrimento de la perspectiva sistémica | Martha A. Fineman and legal equality: Vulnerability vs. Subordiscrimination?(2016) Barrère Unzueta, Mª ÁngelesABSTRACT. This article analyzes (and argues) the American legal scholar Martha A. Fineman’s thesis about vulnerability. It is divided into five sections in which Fineman’s paradigm is successively contextualized, projected to the ECtHR cases on vulnerability and compared with other critical contributions to Antidiscrimination Law. It ends with a brief conclusion that, while recognizing the validity of the diagnosis and the laudable purpose that moves Fineman’s theory, it is critical about taking it as inspiration for a new and necessary concept of legal equality.

- La polis y el polites: orígenes y características de la categoría de ciudadanía | The Polis and the Polites: origins and characteristics of the citizenship category(2016) Ferri, EnricoABSTRACT. The author describes a number of distinctive traits of the status and role of citizens in the democratic Athens of the 5th-century BC and in the Athenian democratic framework which saw the establishment of the figure of the citizen. He highlights the exclusiveness of citizenship and the legal institutes that “closed” access to citizenship status. Citizenship was reserved to males born to Athenian parents, and excluded resident aliens (meteci), the other Greeks and the Barbarians. Starting with the Aristotelian category of “citizens in the absolute sense”, the author shows that even within the community of free Athenians, young people, the elderly and, above all, women, were barred from fully participating in the political life of the city for various reasons. Such categories were in all effects excluded from the decision-making process and from the management of power. At the same time the research shows how Athenian citizens, made up of free men which formed but a minority in the city population, succeeded within two centuries to fully develop a high degree of participation in the political life of the city. It was not long before members of lower-income groups started holding key positions in the city that were previously reserved to individuals belonging to the wealthier classes. It was a turnaround that reflected the full realisation of the democratic principle according to which it was the people of Athens as a whole that governed and defended the choices made with an army made up of Athenian citizens.
- Pensar la paz desde el exterior de las instituciones patriarcales. Ecos de la escritura de Virginia Woolf | Views on peace from outside patriarchal institutions. Echoes of Virginia Woolf’s writing(2016) Bea Pérez, Emilia.Abstract: Today, one of the main tasks of political philosophy and the philosophy of law is, perhaps, to reflect on the need to avoid war and ensure world peace. This paper discusses the contribution made by Virginia Woolf to this reflection in several of her writings and especially in her essay Three Guineas, which is regarded as one of the most striking examples of pacifist thinking by a female writer. Woolf’s anti-fascist, anti-militarist and anti-patriarchal discourse recognises the links between these three deep roots of warmongering. In the face of struggles for power, the reality of living outside the imaginary of power is presented here as an opportunity to carry out unforeseeable civilizing tasks. Women’s experience and knowledge, which has been marginalised throughout history, can be set free subversively and creatively to generate non-violent political practices and aspire to a global redefinition of coexistence.
- La filosofía del derecho mexicana en la era del constitucionalismo(2016) Ortega García, RamónRESUMEN: En este trabajo el autor presenta, en un primer momento, las principales características del modelo constitucional mexicano emergente como detonante de importantes cambios a nivel del ordenamiento jurídico, los mismos que demandan una concepción del derecho diferente a las anteriores para dar cuenta de la nueva realidad normativa del país. El autor describe, después, los elementos más destacables de ese virtual enfoque filosófico y sostiene, al final, que éste mantiene mayor cercanía con el llamado constitucionalismo pospositivista o pospositivismo jurídico de autores como Atienza, Alexy, Nino y otros, que con el constitucionalismo iuspositivista de Ferrajoli. ,

Análisis crítico sobre el derecho al acceso a servicios bancarios básicos en la Unión Europea | Financial Exclusion, Vulnerability and Subordiscrimination. Critical analysis on the right to acces(2016) Cruz Ayuso, Cristina de laABSTRACT. This article analyses the phenomenon of financial exclusion from the perspective of the concept of subordiscrimination. More specifically, it analyses whether the European regulatory framework aimed at ensuring this right contains elements that can lead to the discrimination, arising from its ambiguity and the limits it imposes. First, it presents a review of the literature that provides data on exclusion and discrimination. Second, it analyses the European Directive on Payment Accounts 2014/92/UE. Finally, it focuses on the examination of the Communication Nº 10/1997, Ziad Ben Ahmed Habassi c. Denmark (CERD/C/54/D/10/1997) concerning the refusal of bank loans to noncitizens. - La teoría fuerte de los derechos sociales: reconstrucción y crítica | The Strong Theory of Social Rights: Reconstruction and Criticism(2016) Peña Freire, Antonio ManuelRESUMEN. En este artículo es objeto de análisis la teoría fuerte de los derechos sociales, que es presentada como una teoría unificadora del fundamento, la estructura normativa y los procedimientos de garantía de los diversos tipos de derechos y, en particular, de derechos sociales y de libertad. La teoría es objeto de una serie de consideraciones críticas que apuntan a algunos de sus presupuestos éticos, a sus consecuencias político-constitucionales, a sus problemáticos efectos económicos, al modo en que reconstruye la estructura normativa de los derechos que se considera deficiente y al modelo de garantía judicial propuesto para los derechos sociales que se reputa contraproducente.

- Democracia, argumentación e ideologías jurídicas | Democracy, Argumentation and Legal Ideologies(2016) Cabra Apalategui, José ManuelABSTRACT. This paper analyzes from varied perspectives the relation between democracy and legal argumentation. First, from an external point of view, that points to the political and moral foundations of the argumentative currents of Philosophy of Law. Secondly, it aproaches this relation from an internal point of view, inquiring into the rol of the democratic principle within a general model of argumentative rationlity. And, last, it pretends to characterize the various legal theories/ideologies in the context of constitucional democracy.
- Vulnerabilidad, derechos humanos y empresas | Vulnerability, human rights and business(2016) Barranco Avilés, María del CarmenRESUMEN. El presente trabajo trata de mostrar cómo algunos de los presupuestos teóricos de una concepción tradicional de los derechos, como el modo en el que operan la autonomía y la racionalidad y la forma en la que se articula la separación entre lo público y lo privado, han permitido que resulte fácilmente justificable que las corporaciones y, entre ellas, las empresas transnacionales, sean titulares de derechos humanos, pero también han operado como obstáculos para atribuirles obligaciones. Tales presupuestos han de revisarse para que los derechos humanos sirvan efectivamente para proteger a los seres humanos y no tanto a las ‘personas’ en el sentido jurídico.

- El proyecto Recaséns y la renovación de la Filosofía del Derecho en España | The Recaséns’ Project and The Renovation of Philosophy of Law in Spain(2016) Cuadros Aguilera, PolABSTRACT. This article addresses the renovation effort conducted by the Law philosopher Luis Recaséns Siches, who aimed to update Philosophy of Law in Spain through the introduction of neokantian and kelsenian postulates. What can be denominated as “the Recaséns’ project” was, however, harshly interrupted by the outbreak of the Spanish Civil War. The judgments targeting neokantism that can be found in such texts were included in Recaséns’ later publications, as well as in the work of the professor Legaz y Lacambra, hence yielding the project to maintain some of its original impulse.
- Los orígenes biológicos y los derechos de hijos e hijas: filiación y derecho a saber | Biological Origins and the Rights of Children: Parentage and the Right to Know(2016) Sánchez Martínez, María OlgaABSTRACT. This work has the main purpose of studying how new ways of access to parenthood, through assisted reproductive technologies with donation of gametes or embryos, affect some rights of the children. Specifically, there will be analyzed the children´s right to both a mother and a father and the right to know their biological origins. To do so, it will be central to take into consideration the duty of public authorities to ensure the comprehensive protection of children and enable the investigation of paternity, together with the duty of parents to provide assistance of all kinds to their children. The equality of all children before the law will lead to testing the differences between those born through assisted reproduction, those born by natural reproduction and the adopted ones, and to assess if such differences may continue being justified

The identification of the category "disadvantaged group" or "particularly vulnerable group" is not a closed issue in the anti-discrimination law. However, migrants could be easily considered in a vulnerability situation due to relevant restrictions of social rights fixed by the migration law. Particularly, this proposal analyses the ways of categorizing migrants as potential vulnerable subjects in different Southern European contexts under economic crisis
- ¿Un nuevo paradigma para la igualdad? La vulnerabilidad entre condición humana y situación de indefensión | A new paradigm for equality? Vulnerability as human condition and as a state of defencelessness(2016) Morondo Taramundi, DoloresAbstract: The proposal advanced by US theorist Martha Albertson Fineman for reconceptualising the notion of vulnerability as a human condition, universal, inherent and constant, has acquired growing academic moment in the field of human rights. This new conceptualisation has been presented as the theoretical foundation for a new political and legal paradigm, alternative to liberal theory. This essay assesses some critical points in this new paradigm in its relation with the idea of equality, especially inasmuch as vulnerability appears as a new formula for substantive equality, capable of transcending the limitations of the liberal notion of formal equality and the antidiscrimination law that is founded thereupon.
