ABSTRACT. This paper analyzes from varied perspectives the relation between democracy and legal argumentation. First, from an external point of view, that points to the political and moral foundations of the argumentative currents of Philosophy of Law. Secondly, it aproaches this relation from an internal point of view, inquiring into the rol of the democratic principle within a general model of argumentative rationlity. And, last, it pretends to characterize the various legal theories/ideologies in the context of constitucional democracy.
