    The recognition of the right of the adopted children to maintain contacts or relations with their families of origin and previous welcoming, represents a new model of adoption in the Spanish law, which is called “open adoption” and has been recently introduced by law 26/2015, of 28th July, that amends the Spanish protection system childhood and adolescence. The new regulation is inspired by the law of other countries but there are precedents in certain Spanish regional standards

    La posible aplicación del art. 1.902 C.c. español para indemnizar los daños entre familiares ha sido una cuestión muy discutida. En los últimos quince años los Tribunales españoles se han enfrentado a un novedoso grupo de casos, el de los daños derivados de la ocultación de la verdadera paternidad biológica, concediendo indemnización y dando así entrada a la responsabilidad civil en el ámbito de las relaciones familiares, exigiendo, en la mayoría de las ocasiones, la culpa grave o el dolo como criterio de imputación.

    This paper focuses on the study of the tensions between the progressive autonomy of the child and parental responsibilities. It aims at demonstrating that the Civil and Commercial Code of Argentina resolves these tensions coherently since it encourages and respects the transition of the child and adolescent into his independence while it recognizes the relevant role of parents to guarantee the full protection of their rights

    Favor veritatis ed attribuzione dello status filiationis

    The paper analyzes the main problems concerning the right to know biological origins in development of techniques of human in vitro fertilization (IVF) in Italy, taking into consideration the ECHR case-law. The work highlights how the Italian legal system is characterized by a strong prohibition that may, in some cases, result into unnecessary damages to the children and stimulate questionable interpretations of the best interest principle.

    Aplicação no brasil da convenção sobre os direitos da pessoa com deficiência

    The International Convention on the Rights of Persons with Disabilities replaces the individual, subjective and medical paradigm of the person with mental suffering under the bias of segregation and neutralization of the factual situations with a social model inclusive of human rights, of the promotion of dignity that results in a transcendent turn in the condition of the person with disability, in two manners: a) ensuring access to fundamental rights (housing, health, education); b) reinforcing the private autonomy of the person with disability - even when under a curatorship - by creating and reformulating proportional and flexible legal models that are capable of preserving the space of self care of the subject of such rights, to the extent possible. There is a social context that requires adjustment so that all human beings may actively participate in community life and remain in the center of the decisions that affect them. Legal and sanitary classifications can no longer be based solely on mental health precedents or diagnosis. This new paradigm has an expansive force that spreads into other sectors, requiring a reconfiguration of the limits of the ability to act, the invalidity of business transactions, and the protection of the person and their equity. Incapacity will be a residual, exceptional, and restrictive response used only when the less encumber some alternative of restriction of capacity is inappropriate given the person’s total impossibility of interacting with its environment and expressing their will, and provided that the support system set as initial help for the exercise of capacity is lacking
