    Un Juez de Forli y un Juez de Torino (Italia), de modo separado, remiten sendas cuestiones de constitucionalidad en contra del art. 85, párrafo 1, del Decreto del Presidente de la Republica Nº602, de 29 septiembre de 19732, que regula el cobro de deuda tributaria derivada de impuesto a la renta. La Corte Costituzionale reúne ambos procesos para decidirlos conjuntamente.

    El derecho de oposición de los acreedores de las sociedades comerciales en procesos de fusión en el Código de Comercio boliviano

    El presente trabajo de investigación, contiene un análisis y una crítica a la normativa jurídica contenida en el Código de Comercio Boliviano dirigida a la regulación del derecho de oposición de los acreedores de las sociedades comerciales en procesos de fusión. Observa también, las medidas que asume el Registro de Comercio dentro del trámite correspondiente dirigidas a velar por el cumplimiento del ejercicio de este derecho y, finalmente presenta aquellos elementos que deben ser considerados necesarios para el ejercicio de este derecho.

    La publicidad desleal en la competencia en el ámbito digital: publicidad denigratoria, confusionista y comparativa

    The advertisements broadcasted in the virtual world aim to increase the contract of the goods and/or services offered, attracting potential consumers and/or users of a determined product towards that brand, discouraging contracts with any other competitor. But to be beneficial this corporate behavior, the advertising promotion must be conducted respecting the principle of good faith. In this paper we will refer to three cases of disloyal trade practices from the perspective of the Spanish legal system, namely: the derogatory advertising, the confusionist advertising and the comparative advertising.

    El rebus sic stantibus en la contratación internacional

    After being forgotten in the 19th century, the rebus sic stantibus doctrine was rescued during the 20th century, when it became necessary to restore the contract´s balance when it suffered alterations because of unforeseen events. At the present time, rebus sic stantibus is enforced on plenty nationals systems of law and in international commerce law, where it is considered a general principle of law and a part of lex mercatoria. Also, it is very useful when it is applied in contracts dealing with politically unstable countries with weak legal systems, on which it is more likely that the occurrence of these unforeseen events will disturb the contract obligations.

    Los 20 años de regulación de las cláusulas abusivas

    This paper deals with the evolution and development of the unfair terms regulation during the two decades since the enactment of the European Directive on Unfair Terms in Consumer Contracts, as well as with its legal implications in the Spanish legal system. In this context, the paper explains the concept of general conditions and unfair terms. Also, it highlights the importance of double checking'inclusion test and unfairness test' in order to guarantee the protection of consumer´s interests. Furthermore, the article refers to the changes carried out with the approval of the European Directive on consumer rights following the same goal: the consumer protection.

    The article is limited to the formal aspects developed by the decisions of the Tribunal Constitucional. Therefore, they are equally applicable to all the constitutional rights in the Bolivian legal system. To talk about jurisprudential developments implies to accept the normative character of judicial decisions, for this reason, the article has dedicated one important part to justify and explain the creation of the law by the Judiciary. In the same way, the article also dedicates an important part to explain the limits of constitutional interpretation, considering the fact that the Bolivian Constitution has a specific clause about it. Finally, the article concludes pointing out an eventual contradiction in the jurisprudence, which lies in the fact that while the Tribunal Constitucional has strictly reversed decisions for failing to be properly justified, the same Tribunal fails in justifying whether it is applying the interpretation clause of the Constitution in its decisions.

    This article analyzes the Spanish regulation about the foreclosure proceeding in cases where clauses that may be considered abusive exist, and how the Ruling of the European Court of Justice of 14th March 2013 has influenced on that proceeding, as well as in the modification of the regulation that rules it.
