    Capacidad para contraer matrimonio y prohibiciones matrimoniales: una comparación de las experiencias jurídicas española e italiana

    The research work aims to investigate the system of the requirements and impediments to marriage in Spain and in Italy, making a comparison between the two legal experiences. A first part of the study, after some preliminary considerations, is dedicated to Spanish law. The treatment of Italian law follows. However, the comparison between the two legal systems is constant, in order to highlight similarities and differences. The analysis of these two legal experiences, although culturally similar, allows to affirm that they are, for some aspects, different from the normative point of view, but often similar in the elaboration of the doctrine.

    The Divorce allowance in Italy, between Rules and Principles

    Italian law gives the right to a maintenance allowance to the spouse who does not have ?mezzi adeguati?. The assumption consisting in the ?mancanza di mezzi adeguati?, originally understood by the Joint Sections of the Italian Cassation of 1990 as a lack of resources to maintain the standard of living enjoyed during the marriage, was understood by the Court of Cassation in 2017 as a lack of resources of guaranteeing independence or economic self-sufficiency. In the essay, the author shares this new approach and clarifies that the new interpretation is consistent with the principles and values of the Italian legal system. The author therefore offers arguments to support this new interpretation and hopes that the Joint Sections of the Italian Cassation confirm this interpretation.

    Propiedad y Constitución: Análisis del escenario colombiano

    The purpose of this article is to analyze the legal figures of real estate with no economic exploitation, unoccupied public lands, or unregistered real estate. This paper has been divided into two main parts based on the analysis of uncultivated lands. Afterwards, unregistered real estate will be analyzed, and practical and procedural conclusions will be drawn. This has the purpose of supporting and clarifying if the property is owned by the State or not. This matter is of the utmost importance in current times in Colombia where post-conflict is just around the corner.

    La constitutionnalisation du droit de la famille

    The principles of equality and non-interference in private and family life have led to family law to a considerable evolution. From the point of view of the children, equality is acquired, whatever the origin of the filiation, from the moment in which it has been established. However, regarding adults, differences persist: only married couples have access to certain social rights and to the protection derived from matrimonial economic regimes. In this process the French Courts have only evolved driven by european jurisprudence or by the national law itself. The evolution is not based on the mere invocation of the Constitution, but rather, as a consequence of the integration of rules of european origin in domestic law, including the constitutional one, as a consequence of the influence of the jurisprudence of the European Court of Human Rights

    El uso de la imagen del menor estudiante en los centros educativos (especial atención al uso de las redes sociales)

    In the present study we analyze the use of the image of underage student by a school especially in the social networks. It is analyzed whether freedom of education and freedom of information can justify the use of the image of the child without the need to obtain consent. It also analyzes the use of the student?s image by the school with the consent of the minors or that of the legal representatives, as well as the intervention of the Fiscal Ministry.

    El principio de no discriminación en el derecho contractual ítalo-europeo

    The essay analyzes the progressive assertion of non-discrimination as a principle within Italian and European contract law. After having examinated the legislative concept of contractual discrimination, the scope of the prohibition and the extent of its impact, the Author shows that the direct applicability of the principle of equality within private law relations is inseparable from the issue of the review of contractual autonomy, where it expresses the core essence of the anti-discrimination paradigm. In order to assure full and effective protection, the paper focuses on diversification of techniques for protecting against discrimination and the choice of the ?right? civil remedy.

    Exposición prenatal a drogas: Actuaciones de protección desde el Derecho Civil

    Los niños expuestos prenatalmente a drogas pueden ser considerados un caso especial de infancia en riesgo. La exposición prenatal a drogas se asocia a un amplio rango de complicaciones obstétricas y alteraciones neuroconductuales infantiles. Este trabajo analiza los diferentes mecanismos de protección de menores en situación de riesgo o desamparo que ofrece el Derecho civil, con especial referencia a las últimas reformas de 2015 que modifican la Ley Orgánica 1/1996, de Protección Jurídica del Menor, completando el estudio con las normas autonómicas existentes en la materia.

    A transexualidade no Direito Privado

    The fundamental right of transsexuals to be socially treated according to their gender identity originates from a wide array of civilizing conquests, which began by the recognition of dignity as an intrinsic value of every human being; they have passed through dignity such as the autonomy of every individual, having arrived at the constitutional duty of the democratic state to protect minorities. Because of this multi-centric point of view, the surgical act acquires a new meaning. Instead of clinical prerequisite for changing one?s civil registry, it has been converted into a phase of a long process of conforming one?s sex to one?s gender, progressively revealed in gestures, clothing and hormone treatment and in the web of affective and social relationships constructed by the person in his/her quest for a good life. Following this line of argumentation, the documents will be faithful to one?s human condition, and changing the first name is justified in a prior moment to that when the procedure of physical adequacy materializes in the hands of the physicians. The right to identity passes through the argument of chromosome immutability or the presence of certain genitals, which is the equivalent of confining gender in its morphological element.

    Modificación judicial de la capacidad de obrar como sistema de protección de las personas más vulnerables

    In recent times, under the provisions of the EC, and the influence of the United Nations Convention on persons with disabilities, both the regulation of incapacitation and the interpretation of it by our courts has suffered in our law an important evolution as a system of protection of persons, that has even determined a change in the terminology, being called persons with the capacity modified judicially. Our legislation provides that you can only limit the capacity of people in court for the reasons indicated in the law, being fundamental the impossibility of governing themselves. The sentence will establish the scope of the limitation of the person?s capacity, there is currently a tendency to adapt to the needs of the same limitation, and can be modified in a new process if the physical or mental conditions and selfgovernment of the incapable, since the sentence does not have the efficacy of res judicata. Although it should be noted that a Draft Law on the reform of the legislation on disability has been presented which proposes the elimination of incapacitation and its replacement by certain measures to support the disabled

    Trascendencia de la Constitución en el Derecho Civil venezolano

    The article refers to the relevance of the Constitution in Civil Law in Venezuela. The study is divided into two parts: the first one review the ?Constitutional Civil Law? in its notion, background and some fundamental institutions (person, family and patrimonial relations). The second part, entitled ?The Constitution in Civil Law?, takes a look at some general reflections, the nature of constitutional norms and the interconnection between Public Law and Private Law. The constitutionalization of Civil Law entails incorporating civil institutions into the Constitution as well as having the Fundamental Charter as the basis for interpreting the subject.

    Constituição e Direito privado no ordenamento jurídico português ? o caso da discriminação

    This article focuses on the selection of the counterparty to the conclusion of a contract. It argues that a rejection of a counterparty or a conclusion of the contract in disadvantageous terms, due to personal characteristiscs of the counterparty, might be considered a discriminatory behaviour, against the principle of respect for the personality set in Article 70 of the Portuguese Civil Code. A relational analysis (towards an equality principle) is rejected in this field.

    Il saggio, anche alla luce di casi concreti e delle sentenze più recenti della Corte Costituzionale italiana, dimostra l?impossibilità di identificare ragionevolezza e uguaglianza, nonché i pericoli di una confusione tra ragionevolezza, consenso sociale, prassi e diritto vivente. Bilanciamento e ragionevolezza, quali aspetti fisiologici dell?attività ermeneutica di qualunque operatore giuridico, sono elementi fondamentali per evitare la cecità della mera sussunzione e la tirannia dei valori.
