- El PSOE y la cuestión nacional : la definición de España como una nación de naciones(2020) Payero López, LucíaEste artículo analizará la concepción nacional de España defendida por el PSOE en el 39º Congreso federal, donde se definió España como un Estado plural y se echó mano de la fórmula nación de naciones. Se tratará de determinar si esta manera de conceptualizar España supone una modificación de la idea nacional defendida por el Partido Socialista desde 1977 y, en caso afirmativo, qué extensión y alcance presenta dicha variación.
- A propósito de la reforma de la legislación española en materia de capacidad jurídica : la voluntariedad como nota esencial del apoyo(2020) Martínez-Pujalte, Antonio-LuisIn September 2018, the Spanish Government launched a deep reform of our civil legislation, which will mean a profound change of the traditional regulation of legal capacity. This article focuses on a specific aspect of the proposed reform: the possibility of establishing support measures for the exercise of legal capacity against the explicit will of the person. Firstly, the article examines whether the Convention on the Rights of Persons with Disabilities authorizes involuntary support measures; the conclusions obtained from this examination allow, then, to assess from this point of view the compliance with the Convention of the projected reform.
- Sobre la responsabilidad (ambiental) en la tradición occidental a partir del pensamiento de Nietzsche y Agamben. Una crítica a la noción de ?soberanía?(2020) Fallada García-Valle, Juan RamónA partir de las reflexiones de Nietzsche en torno al pensamiento occidental, se naliza la manera cómo se ha entendido la responsabilidad política y jurídica en sus tres dimensiones (personal, social y ambiental), a través de la contraposición razón-instinto ( o polis-physis, domesticado-salvaje). El particular locus asignado a la noción de "soberanía" en nuestra tradición, a saber, en el intersticio de las contraposiciones mencionadas, lo convierte en el elemento nuclear que articula esos ámbitos de responsabilidad. Finalmente, se critica tal noción de "soberanía", subrayando los problemas que genera para la atribución de responsabilidades en el ámbito ambiental.

- Identidad, sometimiento y exclusión. Vicisitudes de la tolerancia en el mundo antiguo.(2020) Escamilla Castillo, ManuelTolerance is a defining feature of modern society. It arose as a reaction to a previous situation contrary to it and which, in turn, defined human societies from the beginning of time. This previous situation and contrary to tolerance is that of societies defined by collective identities. Studying identity collectivism is a good way to know the idea, demands and limits of tolerance in our societies. This work intends to do it by analyzing it in the first historical societies of the European sphere.
- La obligación de poner en conocimiento : la función pública ante la prevención, detección e intervención frente al acoso sexual en las universidades españolas.(2020) Madrid Pérez, AntonioIn the last years, Spanish universities have developed Protocols for prevention and intervention against sexual harassment. One part of these Protocols establishes public employees are compelled to disclosure to the university authorities about the existence of cases of harassment. However, most of the Protocols omit this obligation. This article analyzes this normative dissimilarity. The text analyzes for what legal and jurisprudential criteria Protocols must incorporate the obligation to notice as differentiated obligation versus the obligation to denounce.
- Los derechos de las personas LGBTI : ¿hacia un derecho a la orientación sexual y la identidad de género?(2020) Martínez de Pisón Cavero, José MaríaThis work addresses the rights of sexual minorities within the framework of the international human rights system. Neither the Universal Declaration of Human Rights nor subsequent treaties contain a specific right that recognizes and ensures a decent life for members of the LGBTI community. This article argues ?a right to sexual orientation and gender identity? is needed in order to protect the special situation of these people in the world. With that aim, the work of the United Nations High Commissioner for Human Rights and the United Nations Human Rights Council is studied and analyzed and reference is made to the jurisprudential doctrine of the European Court of Human Rights.
- Utopía, derecho y moral en Mi lucha de K. O. Knausgård(2020) Misseri, Lucas EmmanuelKnausgård's autobiographical novel is a paradigmatic case for the analysis of the link between law and literature, because it allows us to have three perspectives of it: that of law in, of, and as literature. This article emphasizes the first one. The claim defended is that Knausgård's problematic position of speaking about a "Nazi utopia" is understandable when compared to the problems of speaking about a Nazi law. The most critical aspect of his conception is moral relativism, which prevents him from having a more complete view of the justifying element of utopias and law.

- Tecnología digital : ¿realidad aumentada o deformada?(2020) Ballesteros-Soriano, AlfonsoThis paper aims to offer a humanist approach to digital tecnology by asking: ?Does digital technology increase or disminish the stature of man??, ?does it offer us a better reality or does it distort it?? Here I consider that digital tecnology distorts reality. Distorts human knowledge (epistemological distortion), the individual (antropological distortion) and the relationship with others (socio-political distortion). It might be a lead out to look at the gardener with his sense-based-knowledge, his pacience and his capacity to distinguish between what is given and what is built.
- La interferencia estatal en la vida privada de la gente(2020) Álvarez Medina, SilvinaThis article is about legal regulation of private and family life. It proposes to reflect about the public-private distinction from a gradual perspective, beyond the conception of personal autonomy as an absolute capacity; instead, the article focuses on an interpersonal, contextual and action-oriented approach. This new perspective allows a better understanding of the role of governmental institutions and the law, as regarding family relations and conflicts.
- El Derecho al disfrute del más alto nivel posible de salud en las políticas contra el tabaquismo(2020) Lema Añón, CarlosEl esfuerzo internacional para el control del tabaco incorporó el marco de los derechos humanos de forma tardía y ?paradójicamente- después de que los derechos se alegaran frente a las medidas antitabaco. A pesar de lo avanzado, el marco de derechos humanos todavía tiene potencialidades por explorar en este ámbito. Así, cabría pensar en un uso no defensivo sino proactivo de los derechos, especialmente para la protección de grupos especialmente vulnerables. Además, combinado con el marco de los determinantes sociales de la salud, habría que afrontar que, en diferentes contextos, la mortalidad y morbilidad asociada al tabaco se reparte de forma inequitativa.

To do this, I will begin by briefly describing and analyzing his theses and will oppose two critics: there are no an adequate criterion on when it is justified to defeat a norm, and acts of norm defeat are better understood as changes in the valuation of what conditions should be considered normatively relevant.
- Jurisprudencia comparada sobre aborto : cuando los feminismos impregnan el derecho.(2020) Gonzalez Prado, PatriciaAnalizo críticamente la jurisprudencia sobre aborto de la Corte de los Estados Unidos, el Tribunal Constitucional Español, la Corte Suprema Mexicana y la Corte Suprema Colombiana. Indago los conflictos de derecho que estructuran estos pronunciamientos, las instituciones jurídicas en las que fundan las respuestas a dichos conflictos, y las continuidades y rupturas del reconocimiento del derecho a abortar. Me interesan las contribuciones feministas que las sentencias incorporan y la producción, desde los feminismos, de los argumentos que permiten el abandono del punitivismo en materia de interrupción del embarazo y la estructuración del reconocimiento de esta expresión de la autonomía sexual.
- Vigilar o corregir : modelos de efectividad de los derechos sociales(2020) García Cívico, JesúsSince its conception, social rights have been related to ideas such as those of dignity, equality and social cohesion. They served to cushion the economic differences caused by the market, what capacity do they have today to mitigate the growth of inequality or what is their relationship with social inclusion? Approaches to the effectiveness of social rights have traditionally followed different routes, along with indices and magnitudes relative to income distribution, indicators of social rights have been developed. Most of these models started from variables characteristic of an ?ex post? type of efficiency, ignoring the importance of creating inequalities at the source, as well as a diversification of the responsible agent. This work reflects on the viability of the different models of real efficacy or effectiveness of social rights in relation to inequality, providing ideas for a complex model that includes elements of egalitarian and meritocratic social justice, as well as news related to «Better Regulation» and regulatory impact analysis.
