    Consecuencias de la adjudicación de la custodia individual en las medidas provisionales en cuanto a las posibilidades de una futura custodia compartida en el proceso principal.

    En el presente trabajo se estudia la merma de posibilidades de establecer la custodia compartida de menores, sea en el marco de un proceso de nulidad, separación o divorcio, sea la custodia la cuestión principal del pleito no matrimonial, cuando se ha establecido en el Auto de Medidas Provisionales una custodia exclusiva a uno de los progenitores, ya que es reiterada la jurisprudencia que mantiene la medida establecida en dichas medidas entendiendo que con ello se protege el interés superior del menor. Dado que en las medidas provisionales se suele otorgar la custodia de los menores al miembro de la pareja que suela habitualmente cuidar de ellos, y dado el carácter sumario y urgente del proceso, no entrando al fondo del asunto, su adjudicación sin más de manera individual condiciona y mucho la decisión judicial en el proceso principal. Esta cuestión se relacionará, aunque no de manera exhaustiva, pues no es el tema principal que se pretende tratar aquí, con la dificultad de que prospere una solicitud de Modificación de Medidas, en base al mismo criterio anunciado. Para ello, expondré brevemente el concepto de interés superior del menor, la contradicción legal y jurisprudencial existente en cuanto a la atribución de la custodia compartida y la jurisprudencia que resulte interesante en cuanto al anunciado mantenimiento del ?statu quo?, asunto principal de este trabajo.

    Erradicar la pobreza global: un imperativo moral y un compromiso jurídico.

    This paper analyzes the current context and circumstances in which global poverty unfolds. Although different questions are raised to this end, all of them tend to emphasize, underline and point out the need to offer adequate, effective and far-reaching responses to mitigate this universal human problem. In the process, some limitations in the way the matter is addressed shall be evidenced, while it is highlighted the latest news in the field that the 2030 Agenda has introduced.

    Jurisprudencia postconstitucional relativa a la sucesión de títulos nobiliarios.

    Pudiera pensarse que el artículo 14 de la Constitución Española de 1978, cuando establece el principio de igualdad de los españoles ante la Ley, sin que pueda prevalecer discriminación alguna por razón de nacimiento, raza, sexo, religión, opinión o cualquier otra condición o circunstancia personal o social, es suficiente para zanjar cualquier disputa en torno a la sucesión en los títulos nobiliarios en España. Sin embargo, el carácter indivisible del título nobiliario, la singularidad de su naturaleza, que ha conducido a atribuirle actualmente un ?valor simbólico? y, en ocasiones, las especiales previsiones de su título constitutivo han provocado el planteamiento de una rica casuística a nuestros órganos administrativos competentes, a nuestros Tribunales e incluso al Tribunal Constitucional, que han ido perfilando una interesante jurisprudencia acerca de los límites de la libertad sucesoria y la conformidad de estas previsiones con la Constitución y con las leyes. El objetivo de esta comunicación es el de repasar pronunciamientos jurisprudenciales recaídos con posterioridad a la entrada en vigor de nuestra Constitución, con relación no solo a la primogenitura por razón de sexo, sino también litigios surgidos por razón de hijos matrimoniales y extramatrimoniales, o por razón de la filiación adoptiva frente a la cognaticia y formular algunas reflexiones sobre la singularidad y el valor identitario de la sucesión de títulos nobiliarios así como la proyección de los criterios sentados jurisprudencialmente sobre posibles conflictos futuros que pudieren generar las técnicas de reproducción asistida o subrogada.

    Child?s age is a criterion to be taken into account for the determination of the custody, as well as for its specific configuration; but the early age does not automatically exclude the possibility of adopting a joint custody. In those cases in which sole custody is chosen on the basis of the early child?s age, it is reasonable to do so provisionally, allowing for the possibility of modification after reaching a certain age, without be considered damaging to the stability of the minor

    El deber de declaración del riesgo en el contrato de seguro se configura como un deber de respuesta a las preguntas que le formule el asegurador. Producido el siniestro, el asegurador no puede ampararse, para no cumplir íntegramente con la prestación, en una inexacta apreciación del riesgo, si no ha presentado cuestionario o éste ha sido incompleto.

    The ruling discussed resolves the conflict of interests between the right to be forgotten of the plaintiff and the right to freedom of information of the appellant search engine. The Spanish Supreme Court, in this case, has decided in favour of the prevalence of the right to be forgotten. The sentence has been considered that, in this case, the information indexed by the appellant as a result of searching the name and the surname of the plaintiff on the web engine, does not fulfil the truthfulness requirement and it?s damaging to the privacy of the plaintiff. This sentence contributes to determine the limits of the right to be forgotten.

    This paper seeks to provide a critical analysis of the case-law established by the Spanish Supreme Court judgments 531/2018, of September 26, and 539/2018, of September 28. Both of them consider that the institution of heirs and legacies in favour of the spouse or unmarried partner become automatically ineffective when the beneficiary ceases to be that, even if the testator has not expressly subordinated the effectiveness of the disposition mortis causa to the subsistence of the marriage or relationship at the time of the opening of the succession.

    Medidas de agilización del proceso penal: fijación de plazos máximos para la instrucción

    La voluntad de reducir la duración del proceso penal ha sido una constante en las sucesivas reformas legislativas. La Ley 41/2015, de 5 de octubre, de modificación de la LECrim para la agilización de la justicia penal y el fortalecimiento de las garantías procesales, modifica el art. 324 de la LECrim. estableciendo plazos máximos de duración de la instrucción. La novedad fundamental es que su transcurso afecta directamente el procedimiento, debiendo ponerse fin a la fase de instrucción.

    La traducción en el ámbito de la cooperación jurídica internacional civil.

    In our globalised world there is a growing need for civil legal cooperation between States. In Spain, the applicable legislation is the Civil International Legal Cooperation Act 29/2015 of 30th July which deals with the duty to translate the documents with origin in Spain or abroad. The kind of translation required by said Act as well as by EU regulations will be analysed with special emphasis on EU Regulation 2016/1191. The regulatory development for the Language Interpretation Office foreseen under Additional Provision 16 of Act 2/2014 of 25th March on the State Foreign Action and Service will likewise be examined.

    Limitación de funciones parentales para la salvaguarda del menor en situaciones de violencia de género

    Gender violence is a trending topic in Spanish Law. The normative development carried out in recent years in our country shows a positive evolution on this subject. The initial approach always went from protection to women, but it begins to be taken into account that the child must also be protected in cases of gender violence. These minors, although they have been able to not be mistreated directly, suffer the psychological consequences of the episodes of abuse towards their mothers. It is necessary to address the situation of the child with completeness, since the relations between the parents will be tense in these cases and surely there have been established precautionary measures that prevent the communication between the parents. The child, therefore, will be directly affected by the problems related to their parents. It is highly discussed and delicate to assess what measures can be applied in situations where domestic violence against the child is not exercised, but gender violence in which the child may be affected by emotional abuse within the family environment. The existence of a right to communicate and relate to the father should also be weighted with the interest of the child, taking into account that the exercise of the same could, in some cases, endanger the safety of the child and the mother. We present in this work the problems that this matter presents

    El plan de parentalidad y el coordinador parental: herramientas de protección del menor ante las crisis matrimoniales

    The marital ruptures generate many conflicts between couples who end up also affecting the younger children. The objective will be to analyse the figures known as the Parenting Plan and the parental coordinator, highlighting the benefits that family mediation and Collaborative Law can bring. Also, it will be tried to see if thanks to these tools it is possible to protect the minors involved in the marital crises. It Is true that Aragon, Catalonia, Valencia or the Basque Country recognise in their Foral Right the figure of the parenting plan as a complement to the regulatory agreement. In the same vein, the Draft Law of 10 April 2014 on the exercise of stewardship or other measures after the breakdown of family coexistence proposed the reform of the Civil Code and specifically, Article 90 CC valuing the inclusion of this plan between L Extremes that the regulatory convention should refer to. This Parenting Plan may be advisable when the relationship between the couple is cordial or the degree of conflict is lower since the parents will be able to agree on the minimum rules of play that facilitate the coexistence after the rupture and the protection Of the child in all areas which were not envisaged in the regulatory agreement or which may still be developed in a more detailed manner. However, when the degree of conflict is high, the Judge will be able to appoint the parental or parental coordinator to manage the conflict between the couple and ensure that the child is not affected. We Will study the pilot plans related to this figure and are in operation in Catalonia, Valencia or Madrid, to see if this professional or expert has a place in our order. Therefore, it is intended not only to analyze the parental plan and the parental coordinator, but to see how these figures are being regulated or applied in Spain, conducting a doctrinal and jurisprudential analysis that allows us to propose its inclusion in our Civil Code

    A comparative study of the civil norms that exist in the Spanish territory in relation to the responsibility of heirs for inheritance debts is carried out in this paper. This comparison leads to a clear conclusion: the Spanish legislator must modernize Inheritance law, and there are regional regulations that can serve as a model to be followed.

    Article 1203 of the Spanish Civil Code is generally used as a support to the main thesis in doctrine and civil law jurisprudence that gives the novation a different effectiveness from its traditional one, creating the so-called modificatory novation. The aim of this paper is to reconsider that conclusion, by means of analyzing not only the text of the law but also the different cases it provides.
