    Problemas Abiertos sobre la publicación de los precedentes

    The objective of the present work is to present some of the central problems that arise from considering publication as a requirement for the existence of precedents. I will defend the thesis that publication is not necessary to speak of a system of precedents or of precedents in particular. I will begin by presenting the importance of the publication of precedents. Next, I will analyze what it means to say that we have precedents. Subsequently, I will show different factors that determine the type of publication, and then I will present the problems generated by considering the publication as a requirement for precedents. I will conclude trying to specify what role publication plays in a system of precedents.

    La dialéctica comunitarismo-societarismo detrás del reconocimiento de sistemas de justicia indígenas

    The present study aims to analyze the UN Declaration (2007) of Rights of Indigenous Peoples, using, as theoretical paradigm, the conceptual confrontation of the communitarian and liberal worldviews. From a communitarian perspective it?s will be proposed the principles of subsidiarity and solidarity due their political functionality in the decentralised and plurals States, because they are especially suited in the case of indigenous peoples or nations inside this States. Moreover, it?s will be developed, theoretically, the idea of legal pluralism and his consequences in the Law Theory and State Theory of the XXI century, due this plurality of the legal systems is a defining feature of the cultural and legal complexity in the postmodern society.

    A glimpse of the limits of the European economic governance through the legislative and jurisprudential route of the "after-Weimar" German "economic constitution"

    El objetivo de esta investigación es reconstruir los límites de la gestión de las finanzas públicas en la Unión Monetaria Europea, utilizando la perspectiva del camino de la "constitución económica" alemana posterior a Weimar. El proceso federativo de la UE no presenta las mismas características legales de ningún otro, incluido el alemán. Sin embargo, algunos problemas son necesariamente similares y similares soluciones se pueden encontrar. En consecuencia, esto documento se centra en la sucesión de reformas en la governance económica europea desde 2008 analizando, en particular, el tema de compartir las obligaciones de la deuda a nivel europeo, esto a través del diálogo entre el Bundesverfassungsgericht y la institución de la UE.

    Consecuencias de la STC 76/2019, de 22 de mayo en la privacidad y uso de apps para el control de la COVID. El caso de Radar COVID

    This paper focusses on the consequences for the dialectic between preservation of privacy and the opportunity to take advantage of the possibilities that technology offers us to control epidemics such as COVID. STC 76/2019, of May 22 rules a set of accurate guarantees to be taken into consideration in the design of applications that control and surveillance, justified by the entity of the epidemiological crisis, but which in no case should serve to limit or restrict constitutionally guaranteed rights. This paper will analyze the case of Radar COVID.

    El orden público ante la libertad religiosa. Reflexiones sobre un debate

    A religious practice ?the use of the integral veil? opened an important debate on the limits of public order in relation to religious freedom. Following the Étude of the Council of State adopted in 2010, several distinctions were made: between a material and immaterial conception of public order, between its classical conception and a renewed one and, on the political level, between the liberal and the «republican» conception. The link between public order and religious freedom is not exactly the same as the one it maintains with other freedoms, since political history has united them in reflecting on the foundations of the modern state. The search and justification of the limits of religious freedom leads to a more general questioning of the political and social model of the human community. In other words, this debate on the content of public order is based on whether religions, beyond respecting public order in the strict sense, can be required to respect the moral order of a secularized society.

    El Convenio de Estambul en Francia y en España : tareas pendientes

    El pasado agosto de 2019 el Convenio de Estambul cumplía cinco años desde su entrada en vigor. En su momento, el texto fue ampliamente aplaudido porque supuso un hito en Europa en la lucha contra la violencia ejercida contra la mujer. No obstante, pasado el entusiasmo inicial que despertó en algunos sectores, conviene hacer ahora un balance de sus logros, así como de aquellas medidas que, por diversos motivos, siguen en ciernes, o se han quedado directamente en el tintero.

    Cíborgs : res ipsa loquitur

    En el presente trabajo analizamos el daño desproporcionado sobre la naturaleza humana causado por el fenómeno cíborg a través de su encaje en la regla res ipsa loquitur, o la cosa habla por sí sola. Por un lado, fundamentamos lo que denominados naturaleza humana haciendo referencia a las iguales capacidades humanas, necesarias en el cumplimiento de funciones vitales. Por otro, esta regla recibe también el nombre de daño desproporcionado y su teoría vincula el resultado causado sobre la cosa con la lex artis de una profesión, de ahí que, para su análisis jurídico, hayamos optado por el ámbito sanitario

    El camino hacia el reconocimiento legal de la violencia sexual contra la mujer en tiempos de guerra

    El objetivo de este trabajo es explorar el proceso de configuración de un Derecho Internacional que atienda al fenómeno de la violencia sexual contra las mujeres en contextos de conflictos armados, analizando el alcance del cambio de paradigma logrado en los años noventa con la tipificación y enjuiciamiento de la violencia sexual contra las mujeres en conflictos armados en el ámbito de la justicia penal internacional y, en última instancia, identificando posibles elementos sobre los que seguir avanzando hacia un Derecho Internacional que reconozca un estatus jurídico de las mujeres y huya de la imagen única de la mujer como víctima.

    Tortura y malos tratos en la España democrática

    Torture in contemporary and democratic Spain is a worrying reality, as shown by reports from the most relevant international organizations in the fight against and prevention of torture, such as the European Committee for the Prevention of Torture of the Council of Europe, NGO?s, internal Spanish judgments and, grievously, judgments of the European Court of Human Rights. These sentences of the ECHR have found violations of article 3 of the European Convention on Human Rights, for not carrying out exhaustively and adequately the investigations into complaints of ill-treatment and torture, and in one case for inhuman treatment. These serious facts demand urgent democratic responses with direct and immediate political, legal, and social actions that imply the forceful rejection of them and the condemn of those responsible.

    La Constitución ?social? supranacional como ficción : lecciones de Weimar a propósito de las diferencias entre la falta y la imposibilidad metafísica de cumplimiento constitucional

    In this reflection, we will try to respond to two questions present in the debate generated after the crisis of 2010-2012 of the European project. On the one hand, is it possible to reverse the unconditional centrality of the single market without breaking the Treaties? On the other hand, can the Member States neutralise this centrality through the constitution of the social state form? For this purpose, we will recover, with nuances, the methodological dialectic of the inter-war period in Weimar on politics, power and their relationship with the constitutional law.

    This article formulates the need to approach the reception of Greek and Roman thought by Thomas Jefferson from the perspective of legal philosophy, in order to determine the extent of the influence exercised by schools of thought like Stoicism or Epicureanism, in concepts like Jefferson?s understanding of Natural law. Therefore, it is necessary to clarify if Classical political thought actually transcended a mere formative role or, even, the use as a purely stylistic and formal element, as it has been sometimes defended in the scientific literature.

    La multidimensionalidad de una pandemia. Sociedad y Derecho en la era del post-coronavirus

    The multidimensionality of readings that have been opened derived from the effects of Covid-19 (philosophical, sociological and legal) offers an opportunity to reflect on some dichotomies - in addition to the already classic health / economy - such as risk-fear / alterity, individualism / community, as well as to review some of the stories and narratives that have tried to explain what this crisis has meant and the post-pandemic scenario that could be configured. From the analysis of the philosophical and sociological dimensions, the aim is to lay the foundations to identify which nuclear issues affect the legal dimension and, from there, to point out some parameters about how Law could be rethink in a post-coronavirus scenario

    El constitucionalismo democrático y social : orígenes y características distintivas

    El artículo tiene por objeto reconstruir la evolución doctrinal del pensamiento jurídico en la transición del constitucionalismo liberal ? identificable con las teorías del "Estado de derecho" del siglo XIX ? al constitucionalismo democrático-social que inspira y configura el "Estado social". En resumen, el constitucionalismo democrático-social puede considerarse el núcleo fundamental del pacto social mediante el cual la civilización europea y occidental logra ofrecer una alternativa democrática a la desintegración de los Estados liberales. Los principales rasgos del nuevo constitucionalismo se analizarán centrándose en lo que, en nuestra opinión, puede considerarse sus principales "pilares".
