    La fiscalidad de la familia con menores a cargo

    The family institution is fundamental in every society. The family formed within the marriage or couple in fact deserves the economic and social protection on the part of the public Powers. The present study deals with the taxation that surrounds these institutions when there are minors in their charge. Their taxation will be analyzed within the personal income tax and the application of personal and family circumstances to them. First, the taxation of Large Families will be studied since they have the largest number of minors under their protection, then families made up of married couples and couples in fact who have minors in their care and, finally, we will address taxation in the situation of the family crisis.

    La garantía de la privacidad de los menores de edad.

    El presente estudio ofrece una investigación sistemática, exhaustiva y actualizada de la posición jurídica que ostenta el menor de edad al amparo de la nueva normativa en materia de protección de datos personales, emanada en la actualidad del Reglamento general de protección de datos y de la nueva Ley Orgánica de protección de datos personales y de garantía de los derechos digitales. En concreto, analiza la especial configuración que esta regulación proporciona a los niños como sujetos especialmente protegidos, cuestión que se plasma en diversas obligaciones a cumplir por quienes intervienen como responsables del tratamiento, a fin de otorgar esta protección reforzada. Entre estas obligaciones, se hace especial incidencia, por su relevancia, en las bases jurídicas concurrentes para poder cumplir con el principio de licitud, analizando aquella que, con mayor preeminencia, afecta a los menores de edad, como sucede con el consentimiento, en especial cuando este debe justificar el tratamiento de datos personales especialmente sensibles, como son los datos de salud, en un contexto de crisis sanitaria como el actual, derivado del COVID-19.

    La defensa del interés del menor ante la irrupción de las tecnologías blockchain

    This paper reviews the current legal and technological situation concerning of Blockchain in Europe and its eventual development in Spain. Government will certainly incentive child to ponder the use of blockchain tech and its potential impacts. In doing so, the aim is to stimulate reflection, study about its future regulation and discussion of this complicated, controversial and fast-moving technology.

    El sharenting y el ejercicio de la patria potestad: primeras resoluciones judiciales.

    El sharenting, fenómeno social ampliamente extendido que consiste en que los progenitores publican fotografías y vídeos de sus hijos menores de edad en sus redes sociales, plantea el problema de si es suficiente el consentimiento del progenitor usuario de la red social o es necesario el de ambos progenitores. Acerca de esta cuestión se han pronunciado varias Audiencias Provinciales, cuyas sentencias se analizan en el presente trabajo. Las mismas se refieren, en primer lugar, a la cuestión de en qué medida el sharenting afecta al derecho a la propia imagen y al de protección de datos personales de los menores y cuándo es necesario el consentimiento de los progenitores para la disposición de los citados derechos de la personalidad. En segundo lugar, se posicionan acerca de la cuestión del ejercicio de la patria potestad para la publicación de fotografías y vídeos de los menores de edad, pudiendo distinguirse dos tendencias al respecto, según que se considere que es necesario un ejercicio conjunto por ser ambos progenitores titulares de la patria potestad o individual, en atención al uso social.

    La constitución ante las autoridades españolas de la adopción en supuestos internacionales: cuestiones controvertidas

    The present work analyses the regime of the International Adoption Law for the constitution before the Spanish authorities of an adoption in international cases. First of all, it will be discussed the forums that grant international judicial competence to the Spanish Courts for the constitution of an international adoption, as well as about the consular adoption, foreseen in the articles 14 and 17 IAL. In the second place, the sector of the applicable law will be examined, in relation to which the answers offered in articles 18-20 will be dealt with, without forgetting the reference in article 23 to the Spanish international public policy.

    El bienestar del menor por nacer: ¿un interés a ponderar en el acceso a las técnicas de reproducción asistida?

    La necesidad de aproximar las legislaciones de los distintos Estados europeos en el ámbito de la reproducción asistida, para evitar el llamado ?turismo reproductivo?; así como la conveniencia de realizar una valoración previa de las personas que solicitan ser receptoras de estas técnicas con fines reproductivos, en orden a acercar las distintas formas de filiación, hace que nos planteemos en el presente trabajo la introducción del ?bienestar del menor por nacer? como un ?interés? más a ponderar para acceder a las técnicas de reproducción asistida.

    Very important per se, European regulatory private law is gaining in importance. Universal application is a feature common to the instruments of European private international law. The wording used by the European legislator is usually the following: ?The law designated as applicable by this Regulation shall be applied whether or not it is the law of a Member State?. Irrespective of whether the person(s) involved have made a choice-of-law agreement, there is a possibility that European judges will find themselves having to apply national laws unknown to them. In light of the massive Chinese migration to Europe, the aim of this paper is to identify the main pillars of current Chinese law, helping European judges in arriving at rulings consistent with a legal system not fully in tune with generally accepted European legal principles, considering in particular Chinese family planning and birth control policy

    Since the birth of Victimology, there has been a progressive influence of this science on regulations. It is essential to address the Statute of Victims approved by Act 4/2015, of April 27, which advocates the adoption of measures that reduce the secondary victimization of minors during their time in the criminal process.

    Obligaciones estatales positivas de prevención y medidas de protección civiles para víctimas de violencia doméstica y de género. Una apuesta a favor de su regulación

    Protection orders are the most widely used measures for the protection of gender and domestic violence victims because of the affectivity relationship between the parties. In Spain, protection orders are granted in criminal proceedings and require the existence of a prior event that, at least, has the characteristics of a crime. The Istanbul Convention establishes the obligation of prevention among the positive obligations. We could consider the use of civil protection measures focused on prevention instead of repression and punishment. Furthermore, it would allow us to move closer to other European countries as most of EU countries use civil protection orders.

    A responsabilidade civil dos menores no direito brasileiro.

    The Civil Code of 2002 made substantial changes in the system of extracontractual liability of the minors. There is a provision that allows their personal liability for damage caused by them. However, this liability is subsidiary and mitigated. The legislator set up this framework in order to conciliate human dignity and the protection of vulnerable people with the principle of full reparation. The conciliation is given by the leakage of extremes that only guaranteed dignity to the minors (if the outcome was the refusal of any compensation) or the victims (if the indemnity was total and strongly affects the assets of the minors). This is one of the innovations of the civil code that shows a differentiated approach to the purpose of civil liability.

    El menor como sujeto damnificado en la reproducción asistida humana

    This paper addresses civil liability caused in the process of assisted human reproduction, identifying the subjects involved and the different imputation criteria. The minor receives special attention in it as the main injured subject when the techniques are not applied correctly. The treatment of the subject is carried out from the consideration of assisted reproduction as a medical act and bearing in mind the interest of the minor, as an informing principle of our legal system.

    El interés superior del menor en el marco de la utilización de los métodos alternos de solución de conflictos en el ámbito penal

    The best interests of the minor at present constitute a guiding principle that governs parent-child relationships and regulates the scope of parental responsibility. Its projection has also irradiated the penal sphere, an area in which a series of measures are applied to avoid the re-victimization of the infant. From this perspective, mediation is an ideal way to assertively handle conflict with the intervention of minors. However, the judicial body?s performance is still a question mark, when parents without a well-founded reason deprive the infant, victim of a crime, of participating in a mediation process, carrying a risk of re-victimization due to the emotional exhaustion generated by the criminal process. The article analyzes the best interests of the minor from a transversal approach, accentuated in the penal field, and the limitations that this postulate imposes on the exercise of parental authority. Likewise, the aspects of mediation that qualify it as an effective instrument to guarantee human rights are evaluated, especially those related to the well-being of infants.

    La participación de los niños en el juicio de familia. El mito del Derecho a ser oído

    This work analyzes the participation of children and adolescents in family trials, taking as a parameter the norms of the Convention on the Rights of the Children and other international instruments, which guarantee the right of the child to be heard in judicial proceedings in to resolve matters that concern him. The authors start from the basis that since the entry into force of the Convention and the paradigm shift of the child as a subject of law, the participation of children and adolescents, should be understood as a subjective right that each child can exercise or not, in consideration of their progressive autonomy and best interests. Therefore, the family court must consider it as part of the process, materializing as a manifestation of due process of law.

    La impugnación de los reconocimientos de complacencia.

    This paper contains a study of recognition of paternity made by complacency and the problems that arise when the author of the declaration, as a result of disagreements with his wife or partner, tries to eliminate the filiation created by himself. The study contains a critical study of the thesis maintained by the Supreme Court in its most recent judgements. In these decisions, the recognitions are considered valid, while at the same time legitimation is granted to its author to contest the paternity. The critical analysis of jurisprudential doctrine is accompanied by an argumentative presentation of the value that, in accordance with constitutional principles and current legislation, should be attributed to these recognition of paternity.
