- El desafío de la igualdad domestica a la apertura de las fronteras : el argumento de la singularidad de la coacción estatal | The challenge of domestic equality to the opening of borders: the argument of the singularity of state coercion(2017) Arcos Ramírez, FedericoThe purpose of this paper is to examine one of the most relevant arguments among those used to justify that the members of the same political community owe each other more demanding and strong distributive justice duties than they have with respect to other human beings, to the point of justify a system of closed borders similar to the current one. It is the one that could be denominated like "argument of the singularity of the state coercion". It assumes as an empirical premise that such coercion is structurally and functionally different from what we can find in the international arena, including that which is exercised through the direct prevention and repression of the entry of persons into a given political community by means of border controls.
- Presupuestos hermenéuticos de la teoría comunicacional del derecho de Gregorio Robles | Hermeneutical Assumptions of Gregorio Robles?s Communicational Theory of Law(2017) Santos Arnaiz, José AntonioThe present paper focuses on the hermeneutical assumptions of Gregorio Robles?s communicational theory of law, as doctrine that shows a way of overcoming the dichotomy between analytical philosophy and hermeneutics in order to clarify the language of jurists. For that purpose, it analyzes four of the author?s works from a descriptive and critical point of view that present a greater hermeneutical influence such as Introduction to Legal Theory, Law as Text, Legal Theory and Communication, Language and Law, to tackle the context of the author, his influences, the plausibility of the theory itself within the analytical and hermeneutical framework, and the descriptive and critical analysis of the use of certain concepts of the hermeneutical debate in the communicational theory of law.

Criminal proceedings and collective responsibility(2017) García Pascual, CristinaAccording to the rules of international law, States, in the face of the most serious crimes, have an inescapable obligation, to their own citizens, but also to the international community, to investigate, prosecute and punish those responsible. The development of international criminal law and the binding character of States' obligations have not, however, prevented the prosecution of perpetrators of mass crimes from being often considered an impossible, unrealizable and even not always desirable task. This article will focus on such criticism against criminal law as an appropriate tool in the field of transitional justice
- La apropiación del dominio público y las posibilidades de acceso a los bienes culturales | The appropriation of the public domain and the possibilities of access to cultural goods(2017) Ramos Toledano, JoanThe legislation of continental intellectual property and copyright provide for a period of protection granting exclusive and temporary economic rights. After a certain period, protected works enter into what is called the public domain. This is often considered as the moment in which the cultural goods come under the control and domain of society as a whole. The present paper pretends to argue that, given our current economic system, the public domain actually functions more as a business opportunity for certain companies than as a real option for the public to access artistic and intellectual works.

- La prostitución : el ?pecado? de las mujeres | Prostitution: the ?Sin? of Women(2017) Maqueda Abreu, María LuisaThis article aims to analyze the reasons why prostitutes because of their sexual option have been criminalized by imposing highly coercive normative orders that censure severely their deviation. These normative orders -and their powerful discourses- explain the continuous and endless continuum of stigma, persecution, inferiority, social isolation or imprisonment that accompains the history of prostitution of women and that remain still today in the depths of the sexual hierarchy of society.
- El totus orbis y el ius gentium en Francisco de Vitoria : el equilibrio entre tradición e innovación | Totus orbis and ius gentium in Francisco de Vitoria: the balance between tradition and innovation(2017) Fernández Ruiz-Gálvez, EncarnaciónThe article analyzes two central concepts in the international doctrine of Vitoria: the idea of the orb as a universal community of all human beings and of all peoples united by the bond of common human nature, and ius gentium as the universal law of humanity rules around the world. The work highlights the balance between tradition (cosmopolitan universalism of Stoic and Christian roots and classical natural ius) and innovation (ideas of natural rights, equality and independence of all peoples and conception of the international community as a legal community) and the non-individualistic anthropology that underlies the international doctrine of Vitoria.

- El debate abolicionista en el primer liberalismo español | Abolitionist debate during the first Spanish liberalism(2017) Martínez de Pisón Cavero, José MaríaSpain was the last of the old colonial empires to abolish the slave trade. England, one of the nations that most benefited from trafficking, did so in 1807. However, since the early century XIX, within the first liberalism an initial movement for the abolition of the slave trade emerged in Spain. This paper focuses on three milestones: the defense of the abolition of the slave trade by Isidoro Antillon in his Disertación, read in Madrid in 1802; the Cortes de Cadiz debates on slavery, mainly the session of April 2, 1811; finally, José María Blanco White's contribution to the discussion and the publication in 1814 of his Bosquejo del comercio de esclavos.
