Faced with the deprivation of liberty of a person, it is the State that positions itself as the guarantor of life and physical integrity, so when faced with death under its custody, it is the State that has the obligation to provide a satisfactory and convincing explanation of what happened since it represents a typical example of death suspected of criminality. We present the case of a death in custody of a person deprived of liberty due to disturbances on the public highway where the autopsy and exhumation findings did not demonstrate organic pathology or suitable trauma to cause death
