El valor de la conyugalidad : La conveniencia de una revisión de los derechos sucesorios del cónyuge supérstite y su posible discapacidad ante la nueva realidad socio-familiar

When the marital couple remains firmly anchored in the permanence of their marital bond, that ?conjugality? is the true protagonist of family solidarity within the increasingly reduced family nucleus, until the death of one of its members. Which it?s why it is not convenient to ignore this reality that the legislator refuses to recognize and favor as it deserves. Especially if we consider the possible old age of the survivor, probable disability and/or not very buoyant economic situation. Thus, in this analysis the review of the scarce inheritance rights of the surviving spouse and the limited freedom of will in this aspect is proposed, taking into account the transformations of the Spanish family in recent decades and, especially, of the marital relationship that persist despite the increase in marital crises and subsequent divorces in the current times.
