Abstract
"In the area of health sciences, pathological anatomy is often the least known or the least known of the medical specialties. However, this medical specialty constitutes an important and indispensable base, without which, the rest of the medical specialties could hardly function optimally, since it is interrelated with each and every one of them, contributing to a more complete study of the disease. As for the objective of the research in this article is to identify some aspects, general and particular, on the alleged problematic dilemmas of the professional responsibility of the medical pathologist, in the occurrence of pathological anatomy from cellular to molecular pathology as the great challenge in this XXI century, as well as the likely controversies and, that sometimes may go unnoticed for the medical pathologist to determine whether his responsibility is an obligation of means or results? It is always disturbing and even worrying the indifference with which some professionals of specialized medicine such as the professionals of anatomic pathology, who persist in dismissing the guidance on such a delicate subject as the legal and doctrinal approach of the medical-legal implications of the damages caused as a result of an erroneous interpretation of the results of the histopathological and immunohistochemical study. Probably controversial situations may then arise which, at times, may go unnoticed by the anatomopathologist. Conclusion. The obligation of an anatomic pathologist to make a common pathologic diagnosis based on the analysis of a specimen of a surgical specimen is an ""outcome"" obligation."
