Paz, política y derecho internacional. Una contraposición entre el pacifismo jurídico de Hans Kelsen y el realismo político de Hans J. Morgenthau
This thesis aims to provide an approach to the tensions existing between law and politics in the international arena. In order to do that, it uses the confrontation between the positions of Hans Kelsen and Hans J. Morgenthau. Both authors, immensely influentials in their respectives fields, developed divergent theoretical proposals for the global peace around the decades of the thirties and forties, during the Second World War and during time of building the new international scene created by the Organization of the United Nations. Kelsen defended the famous formula of "peace through law". Morgenthau, however, considered that the main contribution to peace should come from the field of politics. Morgenthau's position, which won a decisive influence on American foreign policy would means the gradual replacement of international law by international relations more and more policy areas.
