- Posthumano y Filosofía del Derecho. Una mirada crítica a la teoría de Rosi Braidotti(2019) Aparicio Chofré, LucíaEl presente artículo presenta una visión crítica de la contribución de la filósofa Rosi Braidotti en la elaboración de algunos de los conceptos filosóficos contemporáneos, en especial de sus conceptos de identidades nómadas y del concepto de posthumano. Una teoría en la se reivindica la necesidad de una responsabilidad 'posthumana' en la que resulta relevante la aportación de la filosofía del derecho a cuestiones tan actuales como son el reconocimiento de derechos de los animales, el control masivo de personas a través de la vigilancia electrónica o la modificación de la identidad sexual en adolescentes. In this article, I will propose some criticisms against Rosi Braidotti theory about "Posthumanism" and "nomad ethics". Braidotti's theory vindicates the need for a "posthuman" responsibility towards both silenced minorities that strives for recognition, and animals. I will argue that her theory needs the support of legal theory in order to face issues such as the recognition of animals' rights, the massive control through Internet or the modification of sexual identity in adolescents.
- Participación ciudadana e inmigración : consideraciones políticas y jurídicas(2019) Castellanos Claramunt, JorgeABSTRACT. Citizen participation is the key element in the work of integration of migrants. The political and legal perspective of this issue are studied in this paper to conclude that the human right to citizen participation is the basis on which to build the XXI century democracies, which will not be able to maintain the citizenship structure of two speeds that they form their society. Integration must be as complete as possible, and this implies greater recognition of the rights of migrants, fundamentally in the context of citizen participation.
- Los matrimonios forzados como violencia de género : aspectos controvertidos desde los feminismos | The forced marriages as a gender based violence: controversial aspects from feminisms(2019) Barcons Campmajó, MariaForced marriages are a form of gender violence and a violation of human rights. When analyzing this complex problem, from the feminisms, some controversial aspects can arise at the same time as necessary, such as the concept of autonomy, consent, multiculturality and intersectionality.
- La prohibición de Ébano swing y Cachita en el primer franquismo (Circular 98) : mucho más que la simple censura de dos temas musicales | The banning of Ébano swing and Cachita in the early years of the Franco regime (Circular 98): much more than the simple censoring of two musical numbers(2019) Centenera Sánchez-Seco, FernandoABSTRACT. This article focuses on the 98th Circular which banned the musical numbers Ébano swing and Cachita in the early years of the Franco regime. It analyses the measure from the perspective of totalitarianism and ponders what led the censor to prohibit both numbers and why such prohibitions did not proliferate. It also studies a number of regulatory shortcomings in the 98th Circular itself and in other legislation concerning the censorship of music, as well as assessing the efficacy of prohibition. Some conclusions bring the article to an end.
- Concepto y concepciones del castigo y su incidencia en la asignación de responsabilidad penal(2019) Torres Ortega, Ilsse CarolinaABSTRACT. In this work, I made a conceptual and justificatory analysis on legal punishment as a important element of the adjudication of criminal responsibility. For this, I proposed that the concept is of a normative nature when it comes to giving an account of how it is used within the legal-punitive practice. I argued that this normative character is articulated in different contents that make up different conceptions of punishment, which constitute the evaluative frameworks to carry out the justification judgment.
- La invención de Borges. Un desafío para las prácticas de lectura e interpretación en el campo del Derecho(2019) Roggero, Jorge LuisABSTRACT. This article proposes to analyze certain features of the Borgesian literature, summarized in the idea of the "invention of Borges", and to investigate its possible application in the field of Law. In every text there are implemented senses, ?established senses? and senses that remain latent waiting to be explained by a reading that finds the possibilities present there. The legal text, like the literary one, admits and demands an interpretation that is capable of combining discovery and creation to respond to the demands of justice.
- La doctrina del efecto desaliento como punto de conexión entre el Derecho penal y los derechos fundamentales(2019) Colomer Bea, DavidABSTRACT. A criminal norm may discourage the exercise of a fundamental right when it is disproportionately applied to conduct bordering on the legitimate exercise of that right. The purpose of this paper is to analyse this effect that criminal norms can produce, known as "chilling effect", taking as an example the events that occurred on 20 September 2017 before the Ministry of Economy of the Catalan Government.

This paper makes a reflection on the crime of genetic manipulation contemplated in Article 159 of the Criminal Code, a provision whose specific regulation raises many objections, especially in attention to the collective legal right that protects, such as genetic identity, questioning itself if this particular behavior would find better accommodation in administrative legislation.
