- Las características formales de la ley humana en Juan de Mariana || The formal characteristics of human law in Juan de Mariana(2018) Centenera Sánchez-Seco, FernandoThis article considers the formal characteristics of human law in the thought of Juan de Mariana. After a general introduction to those characteristics, accompanied by some contextual background, an attempt is made to ascertain the author?s intentions as his thought developed and to analyse his particular contribution to the matter through the double optic of enlightenment thought on the one hand, and contemporary jusphilosophy on the other. Some points of connection are found, but also various significant differences. At the same time, the article also gives some thought to the contribution made by the various aspects under consideration in the fields of justice and of the restriction of power.

- La Unión Europea ante la gestión de la crisis de los refugiados || The European Union faces the refugee crisis(2018) Payero López, LucíaThis article analyses the way in which the EU and its member states are dealing with the so-called refugee crisis. First of all, EU migration policy is assessed in order to show that capitalism and market needs establish the guidelines to be followed when tackling these two issues, migration and asylum. As a result, and in the context of an economic crisis, the number of people admitted into the EU has been dramatically reduced. Even more, foreigners ?migrants and refugees? are blamed on the detrimental effects of crisis, and this is used as a strategy to maintain social cohesion within the national community. This policy has a negative impact not only on refugees and migrants, but also on EU citizens and the EU project itself.
- Derecho inteligente || Smart Law(2018) Martínez García, Jesús IgnacioLaw is one of the most necessary and powerful types of intelligence. The future of humanity depends on it. We should connect legal thinking with the actual discussion on intelligence. This article presents an integrative approach that embraces both artificial, institutional and emotional intelligence. We need smart jurists, provided with new forms of thinking and trained to manage a law working increasingly as a net. Key concepts of legal rationality are components of intelligence. Smart societies depend on smart systems. Institutions appear as smart entities. Law modulates our mental world and our sensibility.
- Sobre el origen de los derechos naturales en los juristas del siglo XII || On Natural Rights? Origin in the Jurists of the XIIth Century(2018) Megías Quirós, José JustoRecently, it has often been attributed to the 12th century decretists the first formulation of natural rights. In this sense, Brian Tierney placed his origin in the works of Rufino and Huguccio, when they commented on the "demonstrative" part of natural law. This thesis would mean bringing forward his birth to an era dominated by the objectivist conception of Law. We examine here the conception of Law in the most important decretists of the second half of the 12th century (Paucapalea, Rufino, Esteban de Tournai, Simón Bisiniano and Huguccio) as well as the relevance that these jurists gave the law from a subjective perspective

- Derechos sociales y deuda. Entre capitalismo y economía de mercado. || Social rights and debt.

Crisis del Estado, justicia intergeneracional y medio ambiente || Human rights in risk society. State crisis, intergenerational justice and environment(2018) Julios Campuzano, Alfonso deThe globalisation era is, as Beck has pointed out, the age of global risk, characterized by the increasing level of risk in the management of technical means. In this context, the insufficiency of a model of understanding human rights linked to the first modernity becomes increasingly evident. Against this, we demand a new paradigm of human rights that, from the global dimension of problems and from an intergenerational conception of justice, transcend the territorial limits of the State and incorporate the dimension of future in the protection of legal assets.
