Tras una breve descripción de la única zona declarada como Santuario Mediterráneo para la protección de los mamíferos marinos, el presente trabajo comenta algunos aspectos jurídicos relativos a este Santuario marino. En primer lugar, centro la atención en la forma cómo se estableció este Santuario marino. Tras diversas iniciativas de diferentes organizaciones no gubernamentales, Italia, Francia y Mónaco establecieron unilateralmente este Santuario marino en sus respectivas legislaciones nacionales y, posteriormente, estos mismos tres Estados adoptaron un convenio internacional hacia este objetivo. Este instrumento internacional se conoce como la Declaración conjunta por la que se establece un Santuario para la protección de los mamíferos marinos en el Mediterráneo (Bruselas, 22 de marzo de 1993). En segundo lugar, se examinan los contenidos de la Declaración conjunta, centrándome principalmente en el análisis de las diferentes medidas jurídicas previstas para garantizar un estado de conservación favorable de los mamíferos marinos en in interior del Santuario. Finalmente también se presta atención al aspecto más débil de la Declaración conjunta que, desde una perspectiva jurídica, consiste en que la Declaración conjunta sólo es obligatoria para los tres Estados que la adoptaron, pero no para el resto de Estados cuyos buques navegan y pescan en estas aguas.

After a brief description of the only area declared as a Mediterranean Sanctuary for the Protection of Marine Mammals, this paper will comment some legal aspects concerning this Marine Sanctuary. First, I will pay attention on how this Marine Sanctuary was established. After some initiatives on different Non-Governmental Organizations, Italy. France and Monaco established unilaterally this Marine Sanctuary in their respective domestic Laws and afterwards these same three States adopted an international convention towards this aim. This international convention is known as the Joint Declaration establishing a Sanctuary for the Protection of Marine Mammals in the Mediterranean (Brussels. 22 March 1993). Second, I will examine the contents of the Joint Declaration, focusing mainly in the analysis of the different legal measures provided for ensuring a favourable state of conservation of marine mammals inside the Marine Sanctuary. Third, I will also devote attention to the weakest aspect of the Joint Declaration, which consist in that, from a legal point of view, the Joint Declaration is only mandatory for the three States that adopted this international convention, but not for the rest of States whose ships sail and fish in these waters.
