Negotiationes in animalibus contrahere: una aproximación a la tipología de los contratos de explotación pecuaria en derecho romano.
The purpose of this paper is to show briefly and analytically the contractual forms of livestock exploitation which Roman law met throughout its history as well as also the vulgar Roman law, especially the western one. Two trends can be observed primarily in this regard: livestock exploitation through lease, which has more modes, and through partnership. The roman contractual type in classical and Justinian law and in roman vulgar law explains the different variants developed in times subsequent and present even in modern legislation. The object of these contracts, pasture animals or animals used for agricultural work, is the reason of the development of a kind of contract called «iron cattle», which alters the traditional regime of contractual liability in prejudice of the tenant or business partner of industry, category who enjoyed historical success despite doctrinal doubts about its validity.
