dc.description.abstract	Este artículo analiza el convenio colectivo sectorial aplicable a las personas dedicadas al reparto mediante bicicleta, monopatín o a pie de comida a domicilio o de productos de supermercados digitales. Para determinar el convenio colectivo de los repartidores se analizará la cuestión sobre la base de cuatro ejes. En el primero se analizará la inclusión del personal de reparto de comida en el sector de la hostelería en España. En el segundo eje se abordará qué ocurre si la empresa que ha contratado al repartidor/a dispone de un convenio de empresa. En tercer lugar, se determinará el convenio colectivo aplicable en los dark stores. En cuarto lugar, se finalizará razonando por qué aplicar el convenio del sector de mensajería puede ser ilegal. This article analyzes the sectoral collective agreement applicable to people dedicated to the distribution by bicycle, skateboard or on foot of food at home or products from digital supermarkets. To determine the collective agreement of the distributors, the issue will be analyzed on the basis of four axes. The first will analyze the inclusion of food delivery personnel in the hospitality sector in Spain. The second axis will address what happens if the company that has hired the delivery person has a company agreement. Third, the applicable collective agreement in dark stores will be determined. Fourth, it will end by reasoning why applying the courier sector agreement may be illegal.
