The Latin-American Investments Agreements have established indirect expropriation since its inception. On the basis of other scenarios, Spain, which has distinct presence of its companies in the Latin-American region has also stipulated it. However, this has not prevented both of them from being sued from investor?s perspective, due to indirect expropriation in International Courts, .due to the insufficient protection provided by their Investments Treaties.
