La base de la Trata de Seres Humanos es la cosificación de las personas. La trata de seres humanos con fines de explotación sexual es una de las grandes lacras de nuestra sociedad civilizada, es hoy en día el segundo negocio criminal más lucrativo por detrás del tráfico de drogas. Es conocida para algunos autores como "la esclavitud del S. XXI" y se plantea como uno de los crímenes más graves que se producen en nuestra sociedad por diferentes motivos. Este tipo de explotación afecta a millones de mujeres, niños y niñas. La explotación sexual del ser humano se puede producir a través de distintos mecanismos, el resultado provoca que la mayor parte de la explotación sexual en el mundo sea de género femenino y produciéndose a través de la prostitución. La población que la consume es mayoritariamente masculina. España actualmente se ha convertido en país de origen, de paso y de llegada a este delito trasnacional. Tradicionalmente se ha convertido la trata como un asunto exclusivamente criminal. Esto ha provocado que se aplicasen estrategias de tipo sexual o migratorias centradas en la criminalización y en el castigo. el resultado de este enfoque ha sido deficiente. Sin embargo, con motivo del incremento de este delito se ha visto un cambio de orientación hacia un enfoque integral basado en los derechos humanos, buscando el establecimiento de las víctimas. En este sentido, si no garantizamos una respuesta eficaz, empática, humana y jurídicamente acorde con la violación de derechos humanos que sufren las mujeres de trata con fines de explotación sexual, seremos cómplices de su revictimización o exclusión de la protección directamente, ya que esta práctica es una forma contemporánea de comercialización y en ocasiones, incluso de esclavización del ser humano. A tal fin se requiere un compromiso social y político con esta problemática centrada en la protección de las víctimas, una toma de conciencia de la gravedad del problema y de las necesidades de afrontarla. Nuestro País se ha implicado en este contexto. Sin embargo, debemos cuestionarnos si se viene cumpliendo con los compromisos adquiridos relativos a la admisión de un enfoque de derechos humanos en materia de trata con fines de explotación sexual.

This type of exploitation affects millions of women, boys and girls. The sexual exploitation of the human being can occur through different mechanisms, the result causes that most of the sexual exploitation in the world is feminine and occurring through prostitution. The population that consumes it is mostly male. Spain has now become a country of origin, of passage and arrival to this transnational crime. Traditionally, trafficking has become an exclusively criminal matter. This has led to the implementation of sexual or migratory strategies focused on criminalization and punishment. The result of this approach has been poor. However, due to the increase in this crime, there has been a change in orientation towards a comprehensive approach based on human rights, seeking the establishment of victims. In this sense, if we do not guarantee an effective, empathic, humane and legally consistent response to the violation of human rights suffered by trafficked women for purposes of sexual exploitation, we will be complicit in their revictimization or exclusion of protection directly, since this Practice is a contemporary form of commercialization and sometimes even enslavement of the human being. To this end, a social and political commitment is required with this problem focused on the protection of victims, an awareness of the seriousness of the problem and the need to address it. Our Country has been involved in this context. However, we must question whether the commitments made regarding the admission of a human rights approach to trafficking for sexual exploitation are being fulfilled.
